Terms of Service

These Terms of Use ("Terms") govern your access to and use of the web applications, Telegram Mini Apps, websites, and services (collectively, "Services") provided by DriveCode ("we", "us", or "our").

By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Services Covered

These Terms apply to all products and services published by DriveCode, including but not limited to:

  • Larko (larko.ai) — business management and automation platform
  • drivecode.ai — corporate website and SaaS development services
  • Mobile applications including:
    • Cosmo Block Puzzle
    • Cosmo Color Sort: Water Puzzle
    • Cosmo Mahjong
    • Cosmo Solitaire: Card Game
    • Cosmo Sudoku: Number Puzzle
  • Any future applications and services published under the DriveCode brand

2. Subscriptions & Billing

Some of our Services, including our mobile applications, offer premium features or content through auto-renewable subscriptions.

  • Larko Payments: All global payments for Larko are processed by Paddle, our official Merchant of Record. By subscribing to Larko, you also agree to Paddle's Terms of Service.
  • Mobile App Payments & Subscriptions (App Store / Google Play):
    • Subscriptions offered in our mobile applications (such as weekly/monthly/yearly premium packages) are processed through the Apple App Store or Google Play Store.
    • Payment: Payment will be charged to your iTunes Account (for iOS apps) or Google Play Account (for Android apps) at confirmation of purchase.
    • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24-hours before the end of the current billing period.
    • Renewal Charge: Your account will be charged for renewal within 24-hours prior to the end of the current period, identifying the cost of the renewal.
    • Free Trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription, where applicable.
  • Managing Subscriptions: Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase (e.g. Settings → Apple ID → Subscriptions on iOS or Google Play → Payments & subscriptions → Subscriptions on Android).

3. Refund Policy

  • Larko Purchases (Paddle): Refund requests for Larko are evaluated on a case-by-case basis. To request a refund, contact us at contact@drivecode.ai within 14 days of purchase. Paddle manages the ultimate processing of approved refunds.
  • Mobile App Purchases: Handled exclusively by Apple or Google. DriveCode cannot process these refunds directly.

4. Account & Data Deletion

  • You can request complete account and data deletion at any time via drivecode.ai/delete-account.
  • Deletion requests are processed within 7 business days.

5. User Obligations

By using our Services, you agree to:

  • Use the Services only for their intended business or personal purpose.
  • Not attempt to reverse-engineer, decompile, or modify our applications.
  • Not use automated bots, scrapers, or other unauthorized access methods.
  • Not input highly sensitive personal information (PII), classified data, or illegal content into our AI-driven platforms.
  • Comply with all applicable laws, including the Terms of Service of underlying platforms like Telegram.

6. Intellectual Property

  • All content, code, design, trademarks, and AI prompts within our Services are owned by DriveCode or its licensors.
  • You may not copy, reproduce, distribute, or create derivative works from our Services without written permission.
  • User-generated business data and inputs remain your property.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our Services are provided "as is" without warranties of any kind.
  • DriveCode is not liable for any indirect, incidental, or consequential damages, business interruptions, or data loss arising from your use of our Services.
  • Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim.

8. Service Availability

  • We strive to keep our Services (including the Larko Telegram Mini App) available 24/7, but we do not guarantee uninterrupted access.
  • We rely on third-party infrastructure (Telegram, Resend, OpenAI), and cannot be held liable for their outages.
  • We may suspend or discontinue any Service at any time with reasonable notice.

9. Changes to These Terms

  • We may update these Terms from time to time.
  • Continued use of our Services after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law provisions.
